1. Scope and provider
These terms apply to all contracts between Stephan Dörner, Bornholmer Str. 89, 10439 Berlin, Germany (the “Provider”) and users regarding the paid features of WhisperQuest (whisperquest.app and desktop distributions). A consumer for the purpose of these terms is any natural person entering into the contract for purposes that are predominantly outside their trade or profession.
2. Services
WhisperQuest provides an AI-assisted role-playing platform. The basic use is free. Credit packs can be purchased to use compute-intensive AI features.
Credits are a digital balance. They have no cash value, are non-transferable, and cannot be refunded as cash. They do not expire.
3. Conclusion of contract
The presentation of credit packs in your account is not a binding offer. By clicking the payment button you submit a binding offer. The contract is concluded once we confirm payment and provide the credits.
4. Prices and payment
The prices displayed at the time of order apply. The Provider applies the small-business rule under § 19 UStG and does not charge VAT.
Payments are processed by Stripe. The available payment methods are shown at checkout.
5. Performance and availability
Credits are credited immediately after successful payment. The Provider aims for high availability but does not guarantee uninterrupted service; short interruptions (e.g. for maintenance) may occur.
6. Right of withdrawal and forfeiture
Consumers have a statutory right of withdrawal — see the separate withdrawal instructions. For digital content (credits), this right expires once you have expressly consented to immediate performance and acknowledged that you lose your right of withdrawal as a result (§ 356 (5) BGB).
7. User obligations
You agree to comply with applicable law and, in particular, not to create or share content that is unlawful, harmful to minors, hate-driven, or infringes third-party rights. The Provider may block content or accounts in case of violations.
8. Liability
The Provider is liable without limitation for intent, gross negligence, injury to life, body, or health, and under the German Product Liability Act. For simple negligence, liability is limited to breach of material contractual duties and capped at the foreseeable damage typical for the contract.
9. Term
Buying a credit pack is a one-time contract. No subscription is created and there is no auto-renewal.
10. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection laws of your country of residence remain unaffected. If any provision is invalid, the remainder of the contract stays in force.
